Terms of Service

These terms exist for one reason: so working together is clear from day one. No fine print, no surprises. Roger de Oca operates through DEOCAs LLC, a service-area business based in Tampa, Florida.

How projects work

Websites come in three kinds, a one-page site, a full site and a site with a blog, described on the pricing page, and extra services such as integrations are added as needed. Prices are not published: every project, plan included, gets a written quote before any work begins, so you know exactly what you are paying for and what you will receive. New sites are built from scratch, and existing sites are rebuilt from scratch, which means a project never consists of taking over and operating a site built on somebody else's platform.

Payment

A 50% deposit starts the project. The deposit is non-refundable: it covers discovery, architecture, and the initial design, the heavy lifting that happens up front. The balance is due when the site goes live, or as stated in your quote. The project can be paid by card through Stripe, by Zelle, by bank transfer or by check. Every monthly plan is charged to a card through Stripe; paying twelve months of the plan up front carries a 15% discount, and that prepayment is not refundable once the year has started.

The site and its monthly plan

The site price plus any add-ons is paid 50% to start and 50% when the site goes live. Each site then continues on a monthly plan, whose scope and price are set in the written quote according to what the site needs: integrations, a blog and ongoing SEO work call for more care. Anything beyond the plan is agreed in writing.

Either way the site is built by Roger de Oca, hosted under the plan, and the domain is always registered in the client's name.

The $67 a month offer

A site of up to twelve pages in each language can also be taken with no build fee, paid only through its monthly plan at $67 a month, charged automatically to the client's card through Stripe, starting once the project is agreed. This option carries a minimum term of six monthly payments; after that it continues month to month and can be cancelled with 30 days notice. If it is cancelled before the six payments are complete, the remaining payments of the minimum term are due, because they are how the build is paid for. Revisions and scope

• One revision round means one consolidated list of changes, sent together.
• Extra revision rounds and extra pages are billed as quoted.
• Scope changes after design approval require a written change order.
• The delivery clock pauses when client content or feedback takes more than 5 business days.

Maintenance subscriptions

Monthly plans follow the published service level agreement:

• First response within 24 business hours, on every plan.
• Critical incidents resolved within 48 hours. Critical means the site is down, forms are not sending, there is an SSL error, or data has been lost.
• Minor changes completed within the billing month.
• A report in plain language, as often as the written quote sets, within the first 5 days of the period.

The free homepage mockup

The free mockup offered on this site is a visual proposal of a homepage, prepared before any payment, at Roger's discretion and within the weekly limit stated on the offer page. It is not a finished website and it does not include code, source files or the right to have it built by someone else at no cost. The business that receives it may keep and use the image. Requesting a mockup creates no obligation for either side, and a mockup that is not followed by a project may be shown as design work in Roger's portfolio without the business name.

The free website scan and the paid audit

The free scan is an automated reading of one public page. Its results, including any performance score, are indicative: scores vary between runs, the tool does not see everything a human review sees, and it is not a guarantee of any outcome. Decisions made on the basis of a free scan are the visitor's own.

The paid website audit ($197) is a written review delivered within five business days of payment, with a call to walk through it. The report is the client's to keep and to hand to anyone. Its fee is credited in full toward a rebuild contracted with Roger within ninety days of delivery.

Domain and hosting

The domain is registered in the client's name from the start and stays that way, and its renewal is part of the monthly plan. Hosting is provided as part of the monthly plan. If the plan ends, the site is paused and hosting under the plan stops. The client can reactivate the site, exactly as it was left, at any point within one year of the last payment by resuming a plan; after one year without a plan the site is deleted permanently. During that year the client can request an export of their content (text, images and data) at any time.

Ownership

Your content is yours from day one: the domain, the copy, the images, the logo and brand, the Google Business Profile, the analytics and search data, and every piece of data the site collects. The site's code and its configuration are built on and for the platform Roger de Oca operates (Next.js on Vercel's infrastructure, with the monitoring and reviews the plan includes); they are licensed to you for as long as a plan is active and are not transferable, because outside that platform they do not run as delivered. Roger may show the finished work in his portfolio.

Warranty

Every launch includes 30 days of bug fixes. If something built as part of the project breaks within that window, it gets fixed at no charge.

Liability

Liability is limited to the amount paid for the service in question. Neither party is responsible for indirect or incidental damages.

Governing law

These terms are governed by the laws of the State of Florida.
