Terms of Service

These terms exist for one reason: so working together is clear from day one. No fine print, no surprises. Roger de Oca operates through DEOCAs LLC, a service-area business based in Tampa, Florida.
How projects work
Services (web design, web development, website redesigns, website audits, monthly maintenance plans, and SEO) are quoted per project. Every project gets a written quote before any work begins, so you know exactly what you are paying for and what you will receive. New sites are built from scratch, and existing sites are rebuilt from scratch, which means a project never consists of taking over and operating a site built on somebody else's platform.
Payment
A 50% deposit starts the project. The deposit is non-refundable: it covers discovery, architecture, and the initial design, the heavy lifting that happens up front. The balance is due as stated in your quote.
Two ways to pay for a site
Every project can be paid in one of two ways, and the written quote states which one applies:
- Pay for the build. The project price, starting at $1,497, is paid 50% to start and 50% at delivery, and the site then continues with a monthly maintenance plan starting at $99.
- Nothing upfront. No payment to start. The site is delivered and paid through a monthly fee starting at $197 that includes the maintenance plan. This option carries a minimum term of twelve monthly payments; after that it continues month to month and can be cancelled with notice before the next billing date. If the agreement is ended before the twelve payments are complete, the remaining payments of the minimum term are due, because they are how the build is paid for.
Under both options the site is built from scratch by Roger de Oca, hosted under the plan, and the domain is always registered in the client's name.
Revisions and scope
- One revision round means one consolidated list of changes, sent together.
- Extra revision rounds and extra pages are billed as quoted.
- Scope changes after design approval require a written change order.
- The delivery clock pauses when client content or feedback takes more than 5 business days.
Maintenance subscriptions
Maintenance plans, whether billed on their own or included in the nothing-upfront monthly fee, follow the published service level agreement:
- First response within 24 business hours.
- Critical incidents resolved within 48 hours. Critical means the site is down, forms are not sending, there is an SSL error, or data has been lost.
- Minor changes completed within the billing month.
- A monthly report delivered within the first 5 days of each month.
The free homepage mockup
The free mockup offered on this site is a visual proposal of a homepage, prepared before any payment, at Roger's discretion and within the weekly limit stated on the offer page. It is not a finished website and it does not include code, source files or the right to have it built by someone else at no cost. The business that receives it may keep and use the image. Requesting a mockup creates no obligation for either side, and a mockup that is not followed by a project may be shown as design work in Roger's portfolio without the business name.
The free website scan and the paid audit
The free scan is an automated reading of one public page. Its results, including any performance score, are indicative: scores vary between runs, the tool does not see everything a human review sees, and it is not a guarantee of any outcome. Decisions made on the basis of a free scan are the visitor's own.
The paid website audit ($197) is a written review delivered within five business days of payment, with a call to walk through it. The report is the client's to keep and to hand to anyone. Its fee is credited in full toward a rebuild contracted with Roger within ninety days of delivery.
Domain and hosting
The domain is registered in the client's name from the start and stays that way. Hosting is provided as part of the maintenance plan. If a plan ends, the client receives an export of the site and thirty days of help to move it, after which hosting under the plan stops.
Ownership
When a project is paid in full, you own your site and your content. Under the nothing-upfront option, your content is yours from day one and full ownership of the site files transfers once the twelve-month minimum has been paid. The site is yours to keep, move, or modify. Roger may show the finished work in his portfolio.
Warranty
Every launch includes 30 days of bug fixes. If something built as part of the project breaks within that window, it gets fixed at no charge.
Liability
Liability is limited to the amount paid for the service in question. Neither party is responsible for indirect or incidental damages.
Governing law
These terms are governed by the laws of the State of Florida.
